Drunk Driver Runs Over Two Cyclists In Baton Rouge

January 25, 2012

The man responsible for running over two cyclists, killing one, and critically injuring the other, is behind bars today in lieu of more than $90,000 in bail on charges of second offense DWI and vehicular homicide. According to reports from WAFB 9 News, the 28-year-old drunk driver responsible for causing the accident hit the men at around 8:45 PM near the intersection of Quail Run and Perkins Road in Baton Rouge, Louisiana.

Both cyclists had helmets on and lights mounted to their bikes, but it wasn’t enough to keep them safe when the man with a blood alcohol level of nearly four times the legal limit rammed them from behind. The cyclists fell to the asphalt where they were then run over by the vehicle. One cyclist, a 30-year-old father, was declared dead at the scene. The other cyclist was taken to a nearby hospital, where he remains in critical condition and faces numerous surgeries to repair the injuries to his legs and ankles.

Baton Rouge City Court records show he was booked for his first DWI on August 3, 2006, when his blood-alcohol level was .241, or more than three times the state’s legal driving limit.

Parents Suing School For The Wrongful Death Of Their Son

October 5, 2011

Parents of a Nicholls State University student who was killed in an on-campus accident while intoxicated have just announced they are filing a lawsuit against the school.

Almost a year ago, around 2:30 on a sunny Saturday afternoon in the midst of homecoming, a 19-year-old college student was riding on a horse-drawn wagon hayride, when he stood up and fell over the front of the wagon. The driver did not see him fall and accidentally ran over him.

Paramedics transported the student to Thibodeaux Regional Medical Center, where he was pronounced dead. It was later discovered that the student’s blood alcohol level was three times above the legal limit, and that the anti-anxiety drug, Valium, was present in his system.

WWLTV News reports that the parents of the Nicholls State University student have filed suit against the University of Louisiana school system for the wrongful death of their son, claiming members of the young man’s fraternity pressured him into the intoxication and drug use that led to his death.

The Louisiana Wrongful Death Attorneys at Dudley Debosier would like to ask your opinion. Should the University and/or his peers be held responsible for the student’s behavior that cost him his life? Or should a 19-year-old adult, be accountable for his own actions? Tell us what you think on our Facebook wall.

Louisiana Teen Drowns After Paddleboat Capsizes

June 8, 2011

An afternoon of revelry on the water with friends turned disastrous for two teens in Eros, Louisiana, when the paddle boat they were on flipped. One of the boys was not able to swim to shore and drowned. WWLTV reports that officials have not released the boy’s name.

Capt. Alan Bankston with the Louisiana Department of Wildlife and Fisheries says the accident occurred Monday evening as two boys were riding a paddleboat on a private pond. For an unknown reason, the boat capsized and the two teens were thrown into the water. One boy was able to swim back to the shore, but when he looked back, he did not see his friend. Officials responded to the call for help at 7:45 PM, and recovered the body about an hour later.

Many people drown every year because they are poor swimmers or cannot swim at all, but feel safe on a boat without a life preserver. The Centers for Disease Control and Prevention did a study that found in 2009, of the 736 people that drowned while on a boating trip, over 90% were not wearing a flotation device of some kind. The same percentages were reported for 2008.

These accidents are often times preventable, but if a mistake is made and an accident does occur on a boat you may need a Louisiana Maritime Injury Attorney on your side. The Attorneys at Dudley Debosier Injury Lawyers work with victims of boat accidents and may be able to help you.

Bill Banning Cell Phone Use While Driving Defeated

June 1, 2011

The Louisiana State Legislature voted late last month not to ban the use of cell phones while driving. Channel 4 WWLTV reports that Rep. Austin Badon introduced the bill in response to the growing number of distracted driving accidents in Louisiana. The legislation would mirror that of many other states by allowing hands-free devices to be used, but making it illegal to operate a manual device while driving. The bill only makes driving and talking a secondary offense, meaning you would have to be pulled over for another offense, and could then receive a ticket for phone use.

Those against the proposed bill argued there were already laws in place to handle these types of situations and offenses. Rep. Jeff Arnold said, “If a police officer sees you driving erratically, it doesn’t matter what you are doing…you can be pulled over for careless operation of a vehicle.”

The House Transportation Committee agreed with Arnold by a count of eight to five, and the bill was defeated for a third year in a row.

Rep. Badon made statements after the house session that he feels it will take a tragedy close to home for committee members to see the importance of this legislation.

Safe Travels Lead To Happy Holidays

May 25, 2011

With Memorial Day weekend just around the corner, a lot of people are focusing on their holiday plans. We can’t wait to ditch the ties or pumps, pack a bag, and hit the road to our favorite places. As such, holiday weekends notoriously lead to heavier traffic on the highway. They also notoriously lead to more fatal accidents on the highway.

In a press release distributed by the Louisiana State Police, authorities responded to ten fatal crashes over the past Easter weekend. Eight out of those ten accidents listed no seatbelt, driver impairment, and speeding as contributing factors.

The report states that one of the accidents in Baton Rouge involved all occupants of the vehicle, including 3 and 5-year-olds, being ejected from the vehicle and sustaining serious, life-threatening injuries.

Two of the accidents involved motorcycles, in which the operator was either not wearing a DOT-approved helmet or not wearing a helmet at all.

Not wearing seat belts, driver impairment, and speed are consistently listed as top factors involved in fatal accidents. There are three simple things you can do to ensure that you and your loved ones do not become a statistic:

    1. Before the car moves, buckle up.
    2. Don’t drink and drive.
    3. Slow Down!

The Louisiana auto accident lawyers with Dudley Debosier Injury Lawyers would like to wish you a happy and safe Memorial Day weekend. Call us if you need help with your car accident case.

Four Die in Gulf Boating Accident

      May 18, 2011

Tragedy struck the small town of Fairhope, Alabama, when it was discovered that four men died in a boating accident in Gulf of Mexico. According to a report by Baldwincountynow.com, the accident occurred off the Louisiana coastline, about an hour after leaving from Venice, Louisiana.

Two of the men, who were brothers, were prominent businessmen in the Fairhope area. The son of one of the brothers survived the accident, and has been able to give officials a better idea of what happened on the water that morning.

Officials were quoted as saying “They left out at around 6:30 a.m. and about an hour later between 7:30-8 a.m. something happened to one of the motors to cause it to shut off…when they looked at the back of the boat, it started filling up with water, and they shut the other motor off. Within minutes the boat had capsized.”

The son was not rescued until about five hours later, when he was found on top of the capsized vessel. He told rescuers that none of the passengers on board the ship were wearing life preservers. Autopsies on the bodies found the cause of death to be drowning, not hypothermia as was suspected originally.
